These Terms of Service ("Terms") govern your use of the Famino app and the online services connected to it (together, the "Service"). Please read them before you use Famino.

The Service is provided by Daniel Prause, c/o COCENTER, Koppoldstr. 1, 86551 Aichach, Germany. You can reach us at service@famino.app.

By using the Service you agree to these Terms. If you do not agree with them, please do not use the Service.

Famino is made for private use by families and households. If you use Famino as a consumer, your statutory rights always remain unaffected by these Terms.

1. What Famino Is

Famino helps a family or household plan everyday life together. The app is available for Android on Google Play. The iOS version is currently distributed through Apple TestFlight; a release on the App Store will follow.

This overview describes the main areas and is not a complete or binding list of features. Features can change over time (see section 12).

2. Accounts and Signing In

You can start using Famino without creating a login. When you set up your profile, the app creates an anonymous account for you, and your entries are stored under that account.

You can later connect a sign-in method to that account: email and password, Google Sign-In, or Sign in with Apple. This secures your data and lets you use the account on another device. Without a connected sign-in method your data stays tied to that one installation, and you cannot invite anyone into your group.

You are responsible for keeping your sign-in details safe and for everything that happens under your account, including the member profiles you create for others. Please tell us at service@famino.app if you notice unauthorized use.

Please provide accurate information. You may only use Famino if you can enter into a binding contract. If you are a minor, you need the consent of your parent or guardian.

3. Groups, Roles and Leaving a Group

Famino organizes everything in a group (the app calls it "Group"; this is your family or household). Each account belongs to one group at a time. You either create a group, and then you are its owner, or you join an existing group with an invitation code.

There are three roles: owner, adult and child. Owners and adults can invite people and create member profiles. An adult can remove children from the group; the owner can remove any member.

3.1 Shared Visibility

Everything created inside a group is shared: appointments, tasks, expenses, recipes, comments and attachments are visible to the members of that group. Only mark information as private if the app offers that option for the entry in question. Do not put information into a group that the other members should not see.

An adult in the group can set up two kinds of member profiles for other people:

Famino does not ask for a date of birth and does not verify anyone's age. Children may use Famino only with the consent of a parent or guardian.

If you set up a profile for a child, you are responsible for that child's use of Famino and for the data entered under that profile. You decide what the child may enter, and you can remove the profile at any time. Removing a member without an account deletes that profile.

5. Free and Premium

Famino can be used free of charge with a reduced set of features. Premium unlocks additional areas, currently expenses with budgets and recurring entries, recipes and the meal plan, timetable, homework and holidays, image attachments, comments, the assisted scanning and import features, and a larger group.

We may apply reasonable limits to keep the Service stable and to prevent misuse, for example on the number of open tasks, on how many entries can be created per week, or on how many members a group can have. Free and Premium have different limits. The limits that apply to you are shown in the app and can change. We will not reduce them in a way that makes a paid subscription substantially less valuable during a period you have already paid for.

6. Subscriptions, Prices and Cancellation

6.1 Where You Buy

Premium is sold as a subscription through the Google Play Store (Android) or the Apple App Store (iOS). Google or Apple is your contract partner for the payment transaction, the billing and any refund. We provide the Service itself. We never receive or store your payment details.

6.2 Plans and Prices

These are the prices for Germany. Prices can differ by country because of local taxes and store pricing. The price shown in the store at the moment of purchase is the price that applies.

6.3 Free Trial

Both plans are offered with a 30 day free trial. Whether the trial is available to you is decided by the store, not by us, and it is normally granted only for a first subscription. If the store does not offer a trial for your account, the subscription starts as a paid subscription right away. The app shows you before the purchase whether a trial applies.

6.4 Renewal and Cancellation

Subscriptions renew automatically at the end of each period until you cancel them, following the rules of the store you bought them in. After a free trial the subscription becomes chargeable unless you cancel before the trial ends.

You cancel in the store, not in Famino: on Android under "Subscriptions" in Google Play, on iOS in your Apple ID settings. The app links you to the right page. After cancelling you keep Premium until the end of the period you have already paid for.

Refunds are handled by Google or Apple under their own rules. Please contact the store you bought the subscription in.

6.5 One Subscription for the Whole Group

A Premium subscription covers the whole group ("Family Premium"). It is bought by the owner of the group and is recorded on the group, so every member of that group has Premium while the subscription is active.

6.6 Changes to Prices and Features

We may change prices and the scope of Premium for the future. A change never affects a period you have already paid for. Price changes for a running subscription are announced by the store and need your confirmation there; without it the subscription ends at the end of the current period.

7. Right of Withdrawal for Consumers

As a consumer you have a statutory right of withdrawal for contracts about digital content and digital services.

Subscriptions are concluded in Google Play or the Apple App Store. For those purchases the withdrawal and refund rules of the respective store apply, and the store handles the process. Please turn to Google or Apple for the withdrawal or refund of a subscription.

Withdrawal instruction for the contract with us

You have the right to withdraw from the contract about the use of Famino within 14 days without giving a reason. The period starts on the day the contract is concluded, which is when you first use the Service. To exercise the right, send us a clear statement by email to service@famino.app. You can use this wording: "I hereby withdraw from the contract I concluded about the use of Famino." Sending the notice before the period ends is enough to keep the deadline.

Your right of withdrawal expires early if we start to provide the Service before the period ends, you have expressly agreed to that start, and you have confirmed that you lose your right of withdrawal once the Service is fully provided.

The use of Famino itself is free of charge for you, so a withdrawal from this contract does not lead to a repayment. Payments are made in the stores and follow the rules described above.

8. Licence to Use the App

We grant you a limited, non exclusive, non transferable and revocable right to install and use Famino on devices you own or control, for your private, non commercial use as described in section 1.

You may not:

This licence ends if you seriously breach these Terms. After that you must stop using the app.

9. Your Content and Rules of Use

You keep all rights to the content you create in Famino: appointments, tasks, comments, expenses, image attachments, recipes and the screenshots you send to support ("your content").

You grant us the right to store, process, transmit and display your content within your group, and to make backup copies, for the sole purpose of running and providing the Service. We do not use your content for advertising, and we do not sell it. Sensitive fields are encrypted before they are stored.

9.1 What Is Not Allowed

You may not upload, store or share content that:

You are responsible for the content you enter, including the photos and documents you attach.

9.2 Reporting Content

If you come across content or behaviour in Famino that breaks these rules, please report it to us at service@famino.app or through the support function in the app. Describe the entry and the group so that we can find it. We look at every report.

Where a report is justified, or where we learn about a breach in another way, we may remove the content, restrict individual features, and suspend or terminate the account involved. If we take such a step against you, we will tell you the reason unless the law prevents us. You can object to a decision by writing to the same address.

10. Assisted Scanning and Import

Famino can read an appointment card or a receipt from a photo and can import a recipe from a web page. These are Premium features.

How this processing works in detail, and which processor is involved, is described in our Privacy Policy.

11. Third Party Services

Famino relies on services from other providers, in particular:

  • Google Firebase: backend, sign-in, database, file storage, server functions, push notifications and error reporting
  • Google Play and Apple App Store: distribution of the app and processing of subscriptions
  • Google Sign-In and Sign in with Apple: optional sign-in methods
  • An EU based processor for the assisted scanning and import features described in section 10

The terms and privacy policies of these providers apply to their own services. We have no influence on outages or changes on their side. Details on data processing are in our Privacy Policy.

12. Availability, Changes and End of the Service

We work to keep Famino available and stable, but we cannot promise uninterrupted availability. Maintenance, faults, network problems and outages at the providers named in section 11 can make the Service temporarily unavailable. We will announce planned maintenance in advance where that is reasonably possible.

We may develop the Service further, change features and stop offering individual features, as long as the purpose described in section 1 is kept and the change is reasonable for you. We will tell you about significant changes in good time.

We may also discontinue the Service as a whole. In that case we will inform you at least three months in advance so that you can save your data. If you have paid for a Premium period that you can no longer use because of this, the store will refund the unused part. Your statutory claims remain unaffected.

You may stop using Famino at any time and delete your account (see section 13). We may terminate the free contract with you with 30 days notice. The right of both sides to terminate for good cause remains unaffected.

13. Deleting Your Account and Automatic Clean-up

You can delete your account yourself in the app, under Settings. Deleting your account removes your profile, the entries you created, your comments, the images you uploaded and the screenshots you sent to support. Entries that other members contributed to can remain visible in the group.

If you are the owner of a group, you cannot delete only your own profile. You delete the whole group instead, which removes all data of that group irreversibly. Deleting an account or a group does not cancel a running subscription, so please cancel it in the store as well (see section 6.4).

The Service keeps your calendar events, expenses, recipes and meal plans until a member of your family deletes them or until the account or family is deleted. Two things are cleaned up automatically: completed tasks are deleted 90 days after you marked them as done, and the image attached to a one-off calendar event is removed 3 years after the event took place while the event itself stays. Please keep your own copy of anything you need as a record, because deletion is immediate and cannot be undone.

14. Intellectual Property

The Service, its software, design, texts, graphics and the name and logo Famino are protected by copyright and other rights, and they remain the property of Daniel Prause or of the respective licensors. Your content is not covered by this; it stays yours (see section 9).

You may not use our name, logo or design for your own products or services without our prior written consent.

15. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent that we have given a guarantee.

In case of slight negligence we are liable only for the breach of a material contractual obligation, meaning an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case our liability is limited to the damage that is typical for this kind of contract and foreseeable when it was concluded.

Any further liability is excluded.

For the loss of data our liability is limited to the effort that would have been needed to restore the data if you had made proper and regular backups. This limit does not apply in the cases of unlimited liability named above.

Nothing in these Terms limits liability that cannot be limited or excluded by law, and your statutory rights as a consumer are not affected.

16. Governing Law and Dispute Resolution

These Terms and your use of the Service are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in another country of the European Union, the mandatory consumer protection rules of that country still apply to you.

For court proceedings the statutory rules on jurisdiction apply. As a consumer you can sue and be sued at the courts that the law provides for; the place of performance is Germany.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of section 36 of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG). If you have a problem, please write to service@famino.app first. We try to solve things directly.

17. Changes to These Terms

We may change these Terms, for example because the law changes, because we add features, or because the way the Service works changes. We will tell you about a change at least 30 days before it takes effect, in the app or by email, and we will say what has changed.

If you do not agree with the new version, you can stop using the Service and delete your account before the change takes effect. Changes never apply retroactively to a period you have already paid for. Your statutory rights remain unaffected.

If a provision of these Terms is or becomes invalid, the rest stays in force. The invalid provision is replaced by the statutory rules.
